بررسی صلاحیت شخصی فاعلی در حقوق جزای بینالملل با تأکید بر حقوق جزای افغانستان؛ چالشها و راهکارها

چکیده
زمینه و هدف: این تحقیق به بررسی صلاحیت شخصی فاعلی در حقوق جزای بینالملل با تأکید بر حقوق جزای افغانستان، چالشهای موجود و ارائۀ راهکارها پرداخته است. با گسترش جرایم فرامرزی، تعیین حدود صلاحیت دولتها برای تعقیب جزایی اتباع خود در خارج از قلمرو سرزمینی اهمیت فزایندهیی یافته است. هدف تحقیق، تبیین چالشهای اعمال این نوع صلاحیت، ارائۀ راهکارها و بررسی جایگاه آن در حقوق جزای بینالملل و افغانستان میباشد.
روش: تحقیق حاضر از نظر روششناسی کیفی و با رویکرد توصیفی– تحلیلی انجام شده و دادهها از طریق مطالعۀ اسنادی و کتابخانهیی گردآوری، تحلیل و مقایسه گردیده است.
یافتهها: یافتهها نشان میدهد که صلاحیت شخصی فاعلی در اسناد بینالمللی و حقوق جزای افغانستان پذیرفته شده، اما اجرای مؤثر آن با چالشهایی چون تعارض صلاحیت دولتها، ضعف همکاریهای قضایی بینالمللی و ... مواجه است.
نتیجهگیری: در نتیجه، تقویت همکاریهای قضایی و هماهنگی مقررات داخلی با موازین بینالملل، میتواند نقش مهمی در تحقق عدالت جزایی ایفا نماید.
