حفظ محرمانه‌گی در قراردادهای تجارتی از منظر حقوق افغانستان

حفظ محرمانه‌گی یکی از دغدغه‌های مهم اسرار در قراردادهای تجارتی است. این امر در قالب حفظ اسرار تجارتی تجلّی می‌یابد و اهمیت آن در این است، که اسرار تجارتی در قراردادهای تجاری، سرمایه و حق برای دارندۀ آن و تعهد بهعدم افشا برای اشخاص دیگر، ایجاد می‌نماید. حفظ اسرار تجارتی در بسیاری از قوانین کشورها و مقررات بین‌المللی مورد حمایت قرار گرفته است. پرسش این است که حقوق افغانستان چه موضعی نسبت به آن اتخاذ نموده است؟ در این تحقیق با استفاده از روش توصیفی- تحلیلی و با استفاده از ابزار کتاب خانه‌یی در پی پاسخ‌یابی به پرسش بالا بوده‌ایم. بررسی قوانین افغانستان نشان‌گر آن است که قانون‌گذار با تصویب قانون ویژه علاوه بر قوانین عام، اسرار تجارتی را به‌عنوان بخشی از حقوق مالکیت فکری معرفی نموده و حفظ محرمانه‌گی آن در قراردادهای تجارتی مورد حمایت قرار گرفته و دارای ضمانت اجراهای مؤثر مدنی یا جزایی و یا هردو می‌باشد.
