Maintaining Confidentiality in Commercial Contracts under Afghan Law

Maintaining confidentiality is one of the major concerns regarding secrets in commercial contracts. This is manifested in the protection of trade secrets, whose significance lies in the fact that trade secrets in commercial contracts constitute both capital and a right for their holder, while creating a commitment for others not to disclose them. The protection of trade secrets has been supported in the laws of many countries as well as in international regulations. The question, however, is what position Afghan law has taken with respect to this matter. In this research, using a descriptive-analytical method and relying on library-based tools, we sought to answer the above question. An examination of Afghan laws indicates that the legislator, by enacting a special law in addition to general laws, has recognized trade secrets as part of intellectual property rights, and their confidentiality in commercial contracts is protected, with effective civil and/or criminal legal sanctions provided.
