Financial Leasing contract in Afghanistan law and UNIDROIT Documents

Financial leasing is one of the most used contracts in the commercial field which takes the financial lessee through rent, which she herself receives from the main owner or seller. The importance of discussing it is to fulfill the expectations that come from its implementation in the direction of investment and economic growth, and the purpose of exploring it is to know the nature and effects of this type of contract. In this research, by using the descriptive-analytical method, the financial leasing contract in Afghanistan law and Unidrava documents has been examined and it has answered this important question, what are the nature and effects of financial leasing? The findings of the research show that this contract has a triangular nature and, unlike conventional contracts, it has three parties: the lessor, the lessee, and the seller, all three of which are connected through two separate lease and sale contracts, and the sale contract is concluded fully related to the contract of the lease. The most important effects of this contract for the lessee are the payment of rent in any condition and the transfer of obligations related to the protection of the leased property to him; While the delivery of the leased object is one of the important obligations of the lessor, the lessor is not responsible for any kind of damage and defect of the property.
