The rule of law and its consequences in Afghanistan law

As the foundation of a law-based state, the rule of law is considered one of the fundamental legal principles in progressive societies. This principle, which is used to uphold the stability and authority of the state and regulate the rights and freedoms of citizens, has a fundamental consequence such as ensuring social justice and the basic rights of citizens. Given that social justice is one of the essential components of an advanced society, examining the foundations of its provision is of particular importance. The purpose of this research is to explain the rule of law and its consequences with an emphasis on the rights of Afghanistan, and it attempts to answer the question: What consequences does the rule of law have? This research was conducted using a descriptive-analytical method and library resources. The research findings show that the most important consequence of the rule of law is ensuring social justice and the fundamental rights of citizens. This is achieved through the formulation of quality laws and their fair implementation. Accordingly, criminal justice actors should act independently and impartially in both the determination and implementation of punishments, taking into account the specific circumstances of the accused and the needs of society. In addition, law enforcement must ensure that citizens feel secure while acting by the law; this leads to the establishment of order, social security, and peace in society.
